General License Terms - Version from August 2024

Software licensing of the Computer Programs TRANSDATpro, SEVENPAR, NTv2Creator, NTv2Poly, NTv2Tools, TOPOWIN, ORTWIN and CONVERT
1. A Single License entitles the licensee to use the program on a single computer in the licensee's place of work.
2. A Network License entitles the licensee to use the program on a single network of the licensee's principal branch / subsidiary / office.
3. A General License entitles the licensee to use the program on all computers and - if the program is network-compatible - on all networks at all branches / subsidiaries / offices of the licensee worldwide.
Software licensing of the Geodetic Development Kit GeoDLL
The designation GeoDLL applies to one or all function groups of the DLL, to the entire DLL or to the C++ source code
1. A Single License entitles the licensee to use the GeoDLL with a single software application developed by the licensee. Applications developed by the licensee can be distributed to any number of customers or can be installed as a single Internet application on the server of the licensee, or the server of the licensee's Internet service provider.
2. A General License entitles the licensee to use the GeoDLL with any number of applications developed by the licensee. Applications developed by the licensee can be distributed to any number of customers and can be installed as a single or multiple Internet applications on the servers of the licensee or the licensee's Internet service provider.
3. A Internal License entitles the licensee to use the GeoDLL with any number of applications developed by the licensee. Applications developed by the licensee may not be distributed to customers and may not be installed as public Internet applications. Applications created with this license must be in context with tasks of research and education.
Software licensing for database tables of the Geodata Germany
1. A Single License for a database table entitles the licensee to use the database in a single application of the licensee. The licensee's application may be distributed to any number of customers or operated as one single Internet application.
2. A General License for a database table entitles the licensee to use the database in any number of applications of the licensee. The licensee's applications may be distributed to any number of customers or operated as several Internet applications.
3. For both license types applies: The database table can be accessed either from a server of the licensee or his internet provider. Or the database table can be delivered together with the licensee's software in encrypted form to his customer. The delivery of the database table in unencrypted form to customers of the licensee is prohibited. The software of the licensee may provide only by the customer requested extracts of manageable size from the database table.
Software license
1. Necessary activation code is a component of the software license. This document is a component of the software license.
2. The software license is considered to be accepted, when the envelope with the unlock parameters is opened, or the seal or plastic foil of the software package is broken, or when the full software version is used for the first time.
3. In order to make the licensee eligible for future software updates at discount prices, a signed copy of the software license should be mailed to the license provider. Information about future updates can be obtained from the license providers E-Mail mailing lists or Internet site. However, there is no entitlement to receive updates.
4. Software licenses can be upgraded at any time to higher license model. The original purchase price will be taken into account.
License subject
1. The software license subject is an executable program, a data base table, a programming tool or the Development Kit GeoDLL, as specified in the license.
2. The license subject also includes all files, user manual and other materials directly related to the components listed in the section 1.
3. Within this document, components, listed in the sections 1 and 2, are collectively referred to as "software".
User rights
1. The license provider guarantees the licensee a simple none-exclusive personal right to use the provided software for unlimited period of time under the terms of the license model described in sections I through IV.
2. The software license does not provide ownership rights.
3. The licensee is allowed to make copies of the software for backup reasons. Making copies of the software beyond the terms and conditions allowed by the purchased license model is strictly forbidden.
4. The software and accompanying documentation are protected by copyright laws. The licensee is not allowed to modify the software in any form beyond the terms and conditions allowed by the purchased license model, without first getting permission from the license provider.
5. The software and the software unlock parameter are not allowed to be sold or passed to third parties.
6. It is the responsibility of the software license to secure the software and the software unlock parameters from unauthorized access.
7. If the integrating of the software into own applications of the licensee is intended, it must be done in a manner that would prevent an easy intentional misuse of the software by third parties.
8. Software licensed as Programming Tool or Development Kit GeoDLL are not allowed to be used in applications which are developed as function libraries or programming tools for use with other applications.
9. Software licensed as Development Kit GeoDLL is not allowed to be integrated in customer or Internet applications, which exclusively or predominantly makes the geodetic computations available accomplished by the software. Example: With the geodetic function group "Coordinate Transformations" of the Development Kit GeoDLL neither customer application nor Internet application may be provided, that's major task is to transform coordinates.
10. The software source code, provided with the software, or source code fragments, are not allowed to be published in any form without the permission of the license provider.
Warranty
1. The license provider guaranties the software to run only on IBM compatible computers. The software license covers only the software that performs according to the user's manual and, is according to it, functional and useful.
2. The license provider guaranties the integrity of the data media purchased directly from the license provider, as well as the software to be functional in the context of the section 1, for the legally prescribed guaranty period in the Federal Republic of Germany after purchase in the amount of the purchasing price. There is no warranty of any kind beyond these conditions.
Disclaimer
1. There is no claim that data included within the software, or the results of calculations performed with the software, or other guaranteed characteristics of the software, will be complete, accurate and correct under any circumstances and in any possible cases. Under no circumstances can damage or subsequent demage, or loss or lost profits, caused by the use of the software, or the inability to use the software, or incorrect, incomplete or inaccurate results of calculations performed with the software, result in a liability.
General note
1. The software license is exclusively under the German law.
2. In case of a dispute between the software license provider and the software licensee about the contents or state of the software license, it falls under the jurisdiction of the locality of the license provider.
3. If some conditions described in this document become fully or partially ineffective, other conditions remain not affected.
